When I was watching a NASCAR race Dairy Queen has a new commercial that when I saw it I got really surprised and I hope The Price Is Right doesn't get surprised and file a lawsuit against Dairy Queen over it. In the commercial a guy is eating a hamburger at Dairy Queen when he dreams he's on a game show while a hostess spins a wheel with prizes of Dairy Queen burgers that looks like the exact same wheel that The Price Is Right has on it's Showcase Showdown round and it makes me think that The Price Is Right asked Dairy Queen permission to use the wheel for the commercial, What's your take on this commercial and do you think Dairy Queen got the idea for the wheel from The Price Is Right?, Kelsey

...and why would DQ be able to sue TPiR over something the latter has used for a good almost-40 years longer?

Even if we were to entertain, for a moment, the ridiculous notion that DQ could get sued over that ad, it would be thrown out of any copyright court in the land. It falls securely under the heading of "parody and/or satire," both of which are exempt from infringement claims (else MAD Magazine and every sketch-comedy series since Saturday Night Live would've been dragged into court decades ago).
Don't read too much into this. It's a tribute, nothing more.
